A Letter to Friends Concerned with Pu Zhiqiang’s Case

One June 9, lawyer Zhang Sizhi’s request to visit Gao Yu at the Beijing No.1 Detention Center was denied, but the detention center granted him a meeting, unsolicited, with another client, Pu Zhiqiang. Zhang’s notes from the meeting, circulated online, state that Pu Zhiqiang is interrogated nearly every day about a wide range of questions, sometimes for up to 10 hours, causing his legs to swell. Pu is quoted as saying: “If this continues, my body’s not up to it.”

As for the case, Zhang states that recent developments have been very unfavorable toward s Pu and warns friends to prepare for bad news. Pu Zhiqiang attended the “2014 June Fourth Seminar” on May 3 in Beijing. He was criminally detained on May 6 after his home was raided on May 5, and arrested on suspicion of “picking quarrels and provoking troubles” and “illegally obtaining personal information” on June 13.

6月9日17时30分,意外地得到机缘会见浦志强,恰在等见之时,网上传出一些关于“会见”的说法,“所”里警官甚表不解,反复解说,“我们安排你单独会见”,其他人不可能仿行。会见室除有一位官员负责安全外,估计没有实施监控措施(如录像),交谈整整一小时未受到任何干扰。浦入室,似乎也感意外,坐定,两人隔窗互握致意。见他长发很湿,应是刚刚洗了头。

以下先归纳浦的谈话要点,加引号处,是原话。

一、“几乎是天天提审,有时长达10小时,现在有些腿肿,估计与时间过长有关系”。老这么干,“身体会招架不住”。

“所”里在看病服药上,“现在挺好”,用上了胰岛素,还送到航空总医院看过一次。

“饮食条件与外面当然不一样,但我在克制。有时一餐只吃一个馒头。”

二、提审的内容宽泛,“罪状”(这个词,出自我)涉及许多方面,他逐一讲了要点,但嘱我“现在不要对外讲”。

陈述中,他说:我的日记、电脑都被抄走了,那上面的许多内容,很难都记得住,一时也讲不清,“等以后核对吧” 。

三、在谈到某项涉嫌问题时,他说:“我估计这个问题会把振红牵扯进来”,说后等我答复。我说,“是的,牵扯到她。”

四、“估计这一两天会下逮捕令,要进入诉讼程序了,担心你身体吃不消,不能累了你。”他紧跟着说,“某人办这个案子,不合适,某人合适些(他点了名,我想暂隐为好)”,“你看……”。我中断了他的思路,说:现在既然没变更强制措施,何必考虑这些事,到时候再作商量也不迟。他未坚持,只是补了一句:“工作量很大,那么多的网络资料,得有个准备。”

五、他语调沉重地说:“律师,以后做不成了,出去以后干什么呢?”停顿下来,若有所思,也许是期盼我说个意见,但我不想用“远景”,替代“愿景”,坚不回应。等了一下,他说:“我曾许过一个愿,不知能不能还上?”再作停顿之后,他说:“今后,会好好照顾家庭,照顾朋友。”“我想念老母亲,还有岳父岳母,不知他们现在好不好?”

我回答说,怪我不好,实在对不住,这些情况我都忽略了,今天没法具体地把情况告诉你。不过你夫人让我转达她对你说的三句话:“面对现实,保持心态平衡,不要乱了方寸;务必搞好身体,这是第一位的;今后生活,会全力照顾你。”

他听后心有所动,说:“听懂了。请她转告儿子:这番经历对他是很好的磨砺,锻炼,从中会学到好多东西,今后能更有出息!”

我告诉他,听夫人说,儿子目前状况很好,也平静,“放心”。

六、告诉孟群,振红儿子的上学问题,要“两家合力”,尽全力供,不能荒废。

振红房子的“按揭”,要按月给她们交上,她丈夫工资低,承担不了。再告诉她--

七、家里的钱不够支出,可以卖房子。律师事务所原先付给我们的“房租”,现在如不再给,不要去要,一切顺其自然,我给所里添了很大麻烦,我知道!

八、谈完“家务”,他问我:“×阿姨好吗?”

“很好。非常关心你。几乎天天同我谈你的事。”

很明显,这种情况使他动了情,于是很难自禁地说:“请代我问候朋友们!我给大家添了麻烦。”而后又专门具体地说:“请告诉×,改行吧,别干现在的事了。不是时候,干不成什么!”

他在“难”中,依然心怀亲友,令人感动!

谈话结束时,他隔窗朝我深鞠一躬,我屈身回报,百感交集。下面报告我的总体观感,作为我对友人的“整体”回答--

第一,精神状态:我概括为:坚毅充分,坚强逊之。必须说明:从未尝过“牢狱之灾”的人,在那样特定的不言“人道”的环境中,不去回顾“往事”,念念亲情,做到纯而又纯的“坚强”,不可思议。我自省办不到。志强谈及亲友,眼眶泛红,忍泪不垂,这种柔情,或者更是可爱处。所谓“逊之”,仅止于客观描述景况而已。

第二,身体状况,我判断,健康水准在下降,实宜“保外就医”,我们前此的申请已被驳回,但驳回的“理由”十分抽象,情属套话,没有一句实质性的东西,因此拟再次提起。

第三,对“案情”有了大致符合客观情势的预计,因而心理准备比较充足。

第四,就“案情”而言,目前的发展对当事人非常不利,侦方下手之重,尽管我有预测,不料仍不到位。

所谓“再有三几天就可能放人”,纯属笑谈;“顶多判个三两年……”,也是幻想。

硬整个“数罪并罚”,何其恐怖?!

作为友人,宜有思想上的准备,否则不易应变。

另有几句题外的心内话--

我作为浦的律师,欢迎对我前段工作的批评、指责。我会有判断上的失误,例如咬定“提审”是拒绝律师会见的借口就是。5月18日,我对记者说,浦案是个平常的案子,我以正常的心态对待。那时是想把问题圈在“寻衅滋事”上,因为浦的“五·三”行为与“寻衅滋事”应属“风马牛”。目前情况已有重大发展,浦案决不是一个平常的案子,人们似不宜用平常的心对之。情况需要集思,需要合力。

同行之间有不同意见是常态,属好事。想法不同,方法各异,风格不同,判断有别,没有什么不好!千万不要因有“异”而弃“同”。目标一致,其他的都可商之议之。贵州小河案中的经验何其宝贵,怎能轻易忘怀?中国律师在大事面前既不糊涂,也不马虎,在要案中群星闪耀,会显出中国律师的力量与光彩。

法律至上,公理必胜!
